Official Rules

NO PURCHASE NECESSARY TO ENTER

 

Eligibility:  Only legal U.S. residents 18 years of age or older with a valid email address located in the U.S. at the time of entry are eligible to enter the "MotoSpace – MotoSport Rider Community Sweepstakes" ("Sweepstakes").  Employees of MotoSport, Inc., its affiliated companies, subsidiaries, retailers, suppliers, vendors, sales representatives, distributors, advertising agencies, promotional suppliers, and their parent companies, agents, officers, directors, and the members of the immediate families and/or persons living in the same household as such individuals, of each of the foregoing, are not eligible to enter the Sweepstakes.

 

How to Enter:  In order to enter the Sweepstakes a contestant must be a member and upload a profile picture. [*]

If you are not currently a MotoSpace.com Rider Community member, you must complete the profile to join the MotoSpace.com Rider Community by clicking the "Join Now" link located at the top of the page at http://www.motospace.com/community, to enter the Sweepstakes.  Complete the entire form and submit it by clicking on the "Join" button at the bottom of the form.  One valid and complete profile, along with a profile picture* entered during the Sweepstakes Period constitutes one entry.

CURRENT MOTOSPACE.COM RIDER COMMUNITY MEMBERS:  All current MotoSpace.com Rider Community members who have posted a profile picture* will be automatically entered in the Sweepstakes when they login to the MotoSpace Rider Community site during the Sweepstakes Period through their previously created MotoSpace.com account.   All current members who have not uploaded a profile picture* and upload one during the Sweepstakes Period will be entered into the Sweepstakes.  Current members will only be allowed one entry into the Sweepstakes during the Sweepstakes Period.  Current members will not be given favorable treatment and will be entered without deference into the random drawing.

This Sweepstakes begins on August 1, 2008 at 11:59AM PST and ends on AUGUST 31, 2008 at 11:59PM PST ("Sweepstakes Period").  Information requested on the entry form consists of having to fill out a complete free user profile to become a member of the MotoSpace – MotoSport Rider Community.  This includes creating a username and profile and providing your email address, date of birth, and the city, state, zip code and country of your residence.  In addition to the profile, members must submit a profile picture.*  LIMIT OF ONE ENTRY PER PERSON AND PER EMAIL ADDRESS.  If there is a dispute about whom the email address belongs to, it will be deemed submitted by the email account holder.  If multiple entries are received for one person or one email address, only the first entry will be considered and subsequent entries will be disqualified.  Entries containing false or fraudulent information will be disqualified.

All members are bound by the Terms of Service at: http://www.motospace.com/community/terms_of_use.php.   These Terms of Service apply to the Sweepstakes.

All information collected through the user profile will be used only in accordance with Sponsor's Privacy Policy at:  http://www.motosport.com/offroad/about/privacypolicy.html.  

 

Prizes:  There will be one Grand Prize consisting of one (1) MotoSport gift certificate, for use to purchase merchandise available on the website http://www.motosport.com ("MotoSport Gift Certificate") in the amount of $250.00 US, with an estimated retail price of $250.00 US.

There will be one Second Place Prize consisting of one (1) MotoSport Gift Certificate, in the amount of $150.00 US, with an estimated retail price of $150.00 US.

There will be two (2) runner up prizes consisting of two (2) MotoSport Gift Certificates, each in the amount of $50.00 US, with an estimated retail price of $50.00 US.

No substitution, transfer, or cash equivalent of prizes is allowed by any winner.  Sponsor, at its sole discretion, may substitute a prize of equal or greater value.  A MotoSport Gift Certificate is not a debit or credit card, and its use is subject to the terms of the MotoSport gift certificate policy.

 

Drawing and Notification:  The Sweepstakes winners will be selected in a random drawing on or about  September 1, 2008 from all eligible entries received by the judge(s), whose decisions are final and binding in all respects.  Odds of winning depend on the number of eligible entries received.  Winners will be notified by email to the email address provided on the completed profile.  If a potential winner cannot be reached at the email address provided and does not respond to the Sponsor at customerservice@motosport.com (or such other email address as may be provided by Sponsor) within five (5) days from Sponsor's first attempt to contact him/her, or is he/she is found to be ineligible, or if he/she cannot or does not otherwise comply with these Official Rules, an alternate winner will be selected by random drawing.  All entries become the property of the Sponsor and will not be returned.

 

General Conditions:  All Federal, state and local laws and regulations are applicable. All taxes (including, but not limited to, income taxes) are the sole responsibility of winners.  Prize winners may be required to execute (and have notarized) an Affidavit of Eligibility, a Liability Release, and a Publicity Release ("Affidavit/Release") which must be returned to and received by Sponsor within ten (10) days from winner's receipt of the Affidavit/Release.  Prize winners will also be required to send a copy of their passport, driver’s license or birth certificate as proof of age.  Any failure to comply with the foregoing will result in disqualification and an alternate winner may be chosen.  Return of the prize, the prize notification, or the Affidavit/Release as undeliverable will result in disqualification and an alternate winner will be selected.  Each winner's entry into the Sweepstakes and/or acceptance of a prize(s) constitutes permission for the Sponsor and its affiliates to use the winner's name, address (city and state) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation on-line, unless prohibited by law.  All entrants agree to comply with these Official Rules.  Any person attempting to defraud or in any way tamper with this Sweepstakes and any person who does not comply with these Official Rules, will be ineligible for prizes and may be prosecuted to the full extent of the law. 

THE OREGON COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF OREGON SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS. 

If, for reasons beyond the Sponsor's control, the Sweepstakes is not capable of running as originally planned, such as tampering or bugs or infection by computer virus, Sponsor at its sole discretion, reserves the right to suspend, cancel or modify the Sweepstakes, without liability.  Sponsor is not responsible for its own or any entrant's computer system, hardware, software or program malfunction or other errors, failures, delayed computer or email transmissions or network connections that are either human or technical in nature.

This Sweepstakes is void where prohibited restricted or taxed by law.

Disclaimers:  All Sweepstakes entrants agree that Sponsor, its affiliates, subsidiaries, retailers, sales representatives, distributors, advertising and promotional agencies, and each of their officers, directors, employees and agents (collectively "Sponsor Affiliates"), shall not be liable for losses or injuries of any kind resulting from acceptance or use, including misuse, of the prize(s), or any entrant's participation in Sweepstakes, or any technical malfunctions of the telephone network, transmission line, computer system or network, computer equipment, hardware, software, or any combination thereof, or any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Official Rules.  Entrants also agree that the Sponsor Affiliates are not responsible or liable for any injury or damage to an entrant's or third person's computer related to or resulting from the Sweepstakes or its prizes.  The Sponsor Affiliates are not liable for damage to a user's computer system in any way due to an entrant's participation in the Sweepstakes or downloading any information in connection with the Sweepstakes, including without limitation any server failure, lost, delayed or corrupted data or other malfunction.  The Sponsor reserves the right to modify or cancel the Sweepstakes in the event that it becomes technically corrupted.
