How to Enter:
If
you are not currently a MotoSpace.com Rider Community member, you must complete
the profile to join the MotoSpace.com Rider Community by clicking the
"Join Now" link located at the top of the page at http://www.motospace.com/community,
to enter the Contest. Each profile form includes creating a username and
profile and providing your email address, date of birth, and the city, state,
zip code and country of your residence. Complete the entire form and submit it by
clicking on the "Join" button at the bottom of the form.
CURRENT
MOTOSPACE.COM RIDER COMMUNITY MEMBERS: will
have their current Community Points reduced to zero at the start of this
contest. Points accrued before the start
date of the Contest will not count towards this Contest, with each member
beginning the Contest on FRIDAY August 1, 2008 at 12:00AM PST with 0 points.
New
and current members who join will have 31 days to accrue the most Community
Points they can. Members will be awarded
points for interacting within the MotoSpace.com website. Community Points will be allocated as
follows:

This
Contest begins on FRIDAY August 1, 2008 at 12:00am PST and ends on Sunday
August 31, 2008 at 11:59PM PST ("Contest Period").
All
members are bound by the Terms of Service at: http://www.motospace.com/community/terms_of_use.php. These Terms of Service apply to the Contest
and the accrual of any Community Points.
All
information collected through the user profile will be used only in accordance
with Sponsor's Privacy Policy at: http://www.motosport.com/offroad/about/privacypolicy.html.
LIMIT
OF ONE ENTRY PER PERSON AND PER EMAIL ADDRESS.
If there is a dispute about whom the email address belongs to, it will
be deemed submitted by the email account holder. If multiple entries are received for one
person or one email address, only the first entry will be considered and
subsequent entries will be disqualified.
Entries containing false or fraudulent information will be disqualified.
Prizes: There will be one Grand Prize consisting of
one (1) pair of TCX Pro 2 Boots, with an estimated retail price of $359.99 US.
There
will be one Second Place Prize consisting of one (1) Industries Kombat Monster
III Helmet, with an estimated retail price of $179.99 US.
There
will be one Third Place Prize consisting of one (1) Shift Wheelie Gear Bag,
with an estimated retail price of $129.99 US.
There
will be one Fourth Place Prize consisting of one (1) Scott No Sweat XI Works
Goggle, with an estimated retail price of $84.95.
No
substitution, transfer, or cash equivalent of prizes is allowed by any
winner. There may be some delay in
receipt of prizes due to availability of color and sizes. Sponsor, at its sole discretion, may
substitute a prize of equal or greater value.
Notification: The Contest winners will be selected once
points are added on or about MONDAY September 1, 2008. Winners will be notified by email to the
email address provided on the completed profile. If a potential winner cannot be reached at
the email address provided and does not respond to the Sponsor at customerservice@motosport.com
(or such other email address as may be provided by Sponsor) within five (5)
days from Sponsor's first attempt to contact him/her, or is he/she is found to
be ineligible, or if he/she cannot or does not otherwise comply with these
Official Rules, an alternate winner will be selected by random drawing. All entries become the property of the
Sponsor and will not be returned.
General
Conditions: All Federal, state and local laws and
regulations are applicable. All taxes (including, but not limited to, income
taxes) are the sole responsibility of winners.
Prize winners may be required to execute (and have notarized) an
Affidavit of Eligibility, a Liability Release, and a Publicity Release
("Affidavit/Release") which must be returned to and received by
Sponsor within ten (10) days from winner's receipt of the
Affidavit/Release. Prize winners will
also be required to send a copy of their passport, driver’s license or birth
certificate as proof of age. Any failure
to comply with the foregoing will result in disqualification and an alternate
winner may be chosen. Return of the
prize, the prize notification, or the Affidavit/Release as undeliverable will
result in disqualification and an alternate winner will be selected. Each winner's entry into the Contest and/or
acceptance of a prize(s) constitutes permission for the Sponsor and its
affiliates to use the winner's name, address (city and state) and/or likeness
for advertising and trade purposes without further compensation, worldwide and
in perpetuity, in any and all forms of media, now known and hereafter devised,
including without limitation on-line, unless prohibited by law. All entrants agree to comply with these
Official Rules. Any person attempting to
defraud or in any way tamper with this Contest and any person who does not comply
with these Official Rules, will be ineligible for prizes and may be prosecuted
to the full extent of the law.
THE
If,
for reasons beyond the Sponsor's control, the Contest is not capable of running
as originally planned, such as tampering or bugs or infection by computer
virus, Sponsor at its sole discretion, reserves the right to suspend, cancel or
modify the Contest, without liability.
Sponsor is not responsible for its own or any entrant's computer system,
hardware, software or program malfunction or other errors, failures, delayed
computer or email transmissions or network connections that are either human or
technical in nature.
This
Contest is void where prohibited, restricted or taxed by law.
Disclaimers: All Contest entrants agree that Sponsor, its
affiliates, subsidiaries, retailers, sales representatives, distributors,
advertising and promotional agencies, and each of their officers, directors,
employees and agents (collectively "Sponsor Affiliates"), shall not
be liable for losses or injuries of any kind resulting from acceptance or use,
including misuse, of the prize(s), or any entrant's participation in Contest,
or any technical malfunctions of the telephone network, transmission line,
computer system or network, computer equipment, hardware, software, or any
combination thereof, or any entries that are late (including delayed data
transmissions), tampered with, garbled, incomplete, misdirected, lost,
mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise
not in compliance with these Official Rules.
Entrants also agree that the Sponsor Affiliates are not responsible or
liable for any injury or damage to an entrant's or third person's computer
related to or resulting from the Contest or its prizes. The Sponsor Affiliates are not liable for
damage to a user's computer system in any way due to an entrant's participation
in the Contest or downloading any information in connection with the Contest,
including without limitation any server failure, lost, delayed or corrupted
data or other malfunction. The Sponsor
reserves the right to modify or cancel the Contest in the event that it becomes
technically corrupted.
