How to Enter: The Contest is open to all registered members of MotoSpace.com - MotoSport Rider Community. If you are not currently a MotoSpace.com - MotoSport Rider Community member ("Registered Community Member"), you must complete the profile to join the MotoSpace.com - MotoSport Rider Community by clicking the "Join Now" link located at the top of the page at http://www.motospace.com/community, to enter the Contest. Complete the entire form and submit it by clicking on the "Join" button at the bottom of the form. Information requested to become a Registered Community Member includes creating a username and profile and providing your email address, date of birth, and the city, state, zip code and country of your residence. Registered Community Members whose profiles contain false or fraudulent information will be disqualified from the Contest. [*]
Registered Community Members may upload their image via the community photo uploader, and all images submitted as entries for the Contest must contain the tag "Summer2009". Entries without the tag "Summer2009" will not be considered for the Contest. Judging will be done by MotoSpace.com Administration Staff using subjective evaluation on the basis of originality, visual appeal, photographic quality, user votes, and comments from Registered Community Members. The decisions of the MotoSpace.com Administration Staff are final and may not be appealed.
Entries must be submitted by the original photographer. Do not submit a photo taken by someone other than you. By submitting an Entry you represent and warrant that you are the sole owner of the copyright of any Entry submitted, that all "moral rights" in the Entry have been waived, and that the Entry does not violate any intellectual property, publicity or moral rights of any third party. Any Entry you post may not contain nudity, violence, offensive subject matter or material copyrighted by a third party. Each Entry is bound by the terms of the Photo Upload Agreement and the Terms of Use.
This Contest begins on November 23, 2009 at 12:00 AM PST and ends on December 21, 2009 at 11:59PM PST ("Contest Period").
All information collected through the user profile will be used only in accordance with the Motospace - Motosport Rider Community Privacy Policy at: http://www.motospace.com/community/privacy.php.
Prizes
The weekly prize wininer will take home (1) "Go Pro Motorsports Hero Camera", estimated retail value of $179.99 US.
No substitution, transfer, or cash equivalent of prizes is allowed by any winner. Sponsor, at its sole discretion, may substitute a prize of equal or greater value.
Drawing and Notification: The Contest winners will be judged on or about each Monday following the previous week's entries. All eligible entries received by the judge(s) will be evaluated. The judge(s) decisions are final and binding in all respects. Winners will be notified by email to the email address provided on the completed profile. If a potential winner cannot be reached at the email address provided and does not respond to the Sponsor at james.wyman@motosport.com (or such other email address as may be provided by Sponsor) within five (5) days from Sponsor's first attempt to contact him/her, or is he/she is found to be ineligible, or if he/she cannot or does not otherwise comply with these Official Rules, an alternate winner will be selected by the judge(s).
License
To the extent permitted by law, by submitting an Entry you grant to Sponsor a non-exclusive, worldwide, perpetual, royalty-free, fully paid license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, transmit and display the Entry and to incorporate the Entry into any other works in any form, media or technology now known or developed in the future, and Sponsor may use or disclose the Entry for any purpose, including without limitation developing, manufacturing and marketing goods and/or services.
Sponsor has the right but is not obligated to use any Entry in the Contest, or to produce, distribute, or exploit any Entry in the Contest.
User Name
Sponsor will have the right to use the user name of any entrant in connection with the distribution, exhibition, advertising, promotion, merchandising and exploitation of the Contest in any media in the U.S.
General Conditions: All Federal, state and local laws and regulations are applicable. All taxes (including, but not limited to, income taxes) are the sole responsibility of winners. Prize winners may be required to execute (and have notarized) an Affidavit of Eligibility, a Liability Release, and a Publicity Release ("Affidavit/Release") which must be returned to and received by Sponsor within ten (10) days from winner's receipt of the Affidavit/Release. Prize winners will also be required to send a copy of their passport, driver's license or birth certificate as proof of age. Any failure to comply with the foregoing will result in disqualification and an alternate winner may be chosen. Return of the prize, the prize notification, or the Affidavit/Release as undeliverable will result in disqualification and an alternate winner will be selected. Each winner's entry into the Contest and/or acceptance of a prize(s) constitutes permission for the Sponsor and its affiliates to use the winner's name, address (city and state) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation on-line, unless prohibited by law. All entrants agree to comply with these Official Rules. Any person attempting to defraud or in any way tamper with this Contest and any person who does not comply with these Official Rules, will be ineligible for prizes and may be prosecuted to the full extent of the law.
THE OREGON COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE CONTEST AND THE LAWS OF THE STATE OF OREGON SHALL GOVERN THE CONTEST. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.
If, for reasons beyond the Sponsor's control, the Contest is not capable of running as originally planned, such as tampering or bugs or infection by computer virus, Sponsor at its sole discretion, reserves the right to suspend, cancel or modify the Contest, without liability. Sponsor is not responsible for its own or any entrant's computer system, hardware, software or program malfunction or other errors, failures, delayed computer or email transmissions or network connections that are either human or technical in nature.
This Contest is void where prohibited, restricted, or taxed by law.
Waivers and Disclaimers: All Contest entrants agree that Sponsor, its affiliates, subsidiaries, retailers, sales representatives, distributors, advertising and promotional agencies, and each of their officers, directors, employees and agents (collectively "Sponsor Affiliates"), shall not be liable, and waive all claims, for losses or injuries of any kind resulting from acceptance or use, including misuse, of the prize(s), or any entrant's participation in Contest, or any technical malfunctions of the telephone network, transmission line, computer system or network, computer equipment, hardware, software, or any combination thereof, or any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Official Rules. Entrants also agree that the Sponsor Affiliates are not responsible or liable, and waive all claims, for any injury or damage to an entrant's or third person's computer related to or resulting from the Contest or its prizes. Entrants also agree that the Sponsor Affiliates are not liable, and waive all claims, for damage to a user's computer system in any way due to an entrant's participation in the Contest or downloading any information in connection with the Contest, including without limitation any server failure, lost, delayed or corrupted data or other malfunction. The Sponsor reserves the right to modify or cancel the Contest in the event that in the Sponsor's sole judgment it becomes technically corrupted.
